OLDPAIN2GO – A STATEMENT FROM A CERTIFIED PRACTITIONER
I make the comments which follow based on having been a Professional Mind Therapy Practitioner since 1989, having won numerous Legal Copyright Claims in the past and having experienced OldPain2Go training with Martin Rothery and personally knowing lots of people who have trained with Martin and also some who have trained with Steven Blake.
In reply to Steven Blakes recent Statement which he has posted publicly on Facebook (as per copy and paste at bottom of this post) I make the following comments
The cold hard truth is that OldPain2Go was, and still is unless Steven has made changes without telling us, nothing more than a Brand Name and a Logo which he managed to Trade Mark.
As for the actual content and process of the technique being taught, as many have pointed out it is essentially already published in Bandler’s “Frogs into Princes” and a Myriad of other books including some by the Rogue Hypnotist, One by Tad James and many others that predate the OldPain2Go Brand by many decades.
So to clarify clearly, at all times, anyone who has attended training with Martin Rothery has been taught the exact system that Steven Blake claims to be original and has given the name of OldPain2Go (when it is not original and in truth is as old as the hills) to OldPain2Go)
However Martin has always openly acknowledged to many that the actual technique is older than both he and Stevens ages added together.
It is perhaps ironic to note that Steven Blake when I had passed my OldPain2Go course with Martin and during it made it clear to Martin that THIS IS NOTHING NEW and indeed I’ve taught all components of it in the past many years ago in various of my live courses based on stuff that is in print many decades earlier by various people, that Steven posted this comment on my personal Profile of which I quote:
“Interesting Alex as I learned so much from your training materials about 5 years ago. Thanks.”

NO idea which DVDS of mine he had seen, but it is perhaps possible he has had “Confessions of a Hypnotist” which covers Pendulums, IMR and Subconscious Communication or some others such as “Mind Changes” that covers as I recall Part Therapy and 6 Step Reframe etc.

For the record I have no Personal Issues with Steven Blake, any issues I have ever had have been about Professional Ethics and Lacks in Duty of Care Standards as outlined at the following blog post link
So basically the bottom line is this, OldPain2Go IS NOTHING NEW and the process/technique CANNOT ever be Copyrighted, especially as its already in print numerous times in the past under other names by other people.
However the Logo and Name of OldPain2Go could be Trademarked and that is what Steven Blake did which is great business and marketing of which nobody can deny, although that said I’ve in the past couple of days developed TWO Much Better Brand Names and TWO much better ideas for Logos for “Pain Elimination & Management Systems”
Both of these I have Gifted to Martin Rothery and it is entirely up to him whether he wishes to use them, however Copyright (and Trademark) has already been generated and created and thus anyone other than Martin attempting to use my intellectual property and newly created Trademarks which I am gifting to Martin should beware of extreme legal consequences!
These Brands I have created and gifted to Martin on condition that if he does not wish to use them, then I shall retain them for my own usage include:

NOTE = S.T.E.P.S. Logo will be a Step Ladder with the letters S-T-E-P-S between each steps.
NOTE = Although originally intended as a system of helping people to eliminate long-term Pain from their lives, it has become clear that S.T.E.P..S – (Subconsciously Therapeutic Elimination of Pain Signals & Symptoms) is equally effective in helping people to climb over many other obstacles in life and enables them to move forward positively leaving past Habits, Addictions, Fears, Phobias and other issues behind..
And it would say that such qualification also includes and incorporates competence in:
P.A.I.N. – F.R.E.E. = Pendulum Assisted internal negotiation Fast Release Entrapped Emotions/Energy.
NOTE = P.A.I.N-F.R.E.E. = That logo would involve a Pendulum

Whether Martin decides to use these brands or creates his own is immaterial to the facts that:
a) Anyone who trained in OldPain2Go with Martin not only learnt OldPain2Go as Steven Blake intended it (and modelled/copied from elsewhere) but also they were shown how to use it for many other things other than just Pain and thus GOT BETTER VALUE FOR MONEY and better training and thus I cannot see on any level how they could ever realistically, ethically, morally or honestly ever desire or wish to claim a refund. Despite this Steven Blake seems to be trying to goad people into doing this.
b) I know that whatever name Martin finally uses that he intends to offer FREE (either in person in a group event or via Zoom online in a group) training in his new brand to those he has previously trained in OldPain2Go.
c) There is nothing in Law (as far as I can see) to stop anyone who has trained with Martin and received an OldPain2Go diploma to continue using their Diploma, offering OldPain2Go and/or using the Practitioner Logo, because at the end of the day they have Learnt and been legally qualified in OldPain2Go.
d) Therefore ALL those who have trained with Martin now have the chance to gain a NEW additional Qualification Diploma, A New Logo and a New “Name” to use along with some added “bits and bobs” in terms of additional techniques that may not have been taught previously by Martin when he ran OldPain2Go courses.

Also Whether Martin chooses to use the Brand Names I have created for him or not, is irrelevant to the fact that with my vast personal experience in Copyright Law..
(including presenting my own case against someone which I won at The High Court leading to the Judge directing me to write out the Court order against the Guilty party which he later commended me on in court)
With that experience and the knowledge I have of copyright law, and from what I can see that is in the public domain and have seen through various other sources previously, nothing has been breached by Martin in terms of intellectual properties and/or copyrights and any such attempted claim otherwise would and could (I strongly suspect) be considered a Vexatious claim.
There is nothing legally to stop Martin from teaching the techniques contained within “Frogs into Princes” – “The Rogue Hypnotists” Books, my training DVDs and Elite Hypnosis Bootcamp and those contained in many other books which are many decades older, just so long as any Trademarked names are not used and that (as best is known) the original creators and/or lineage of such techniques is fully explained/revealed to those being taught.
Any suggestions being made to imply that Martin has committed (or may have) any kind of intellectual copyright theft are as far as I can see completely without basis or foundation in law and appear to be a thinly veiled attempt to discredit Martin and harm his reputation in light of the massive and positive public support he has been shown in this matter.

Given that as I understand it Martin has trained around a third (approx 33.3%) of all the people currently holding diplomas in OldPain2Go and for most he has been the most visible and positive face of the brand, I’m afraid that it looks and feels like this is a case of feelings of “Lack of Control” and “Ego” issues creeping in that may well have been the true motivation for Steven Blakes actions.
Sadly Steven Blake has published a statement which appears to be goading people trained in OldPain2Go by Martin to demand a refund, despite the fact that as already explained they would have no Legal, Lawful, Moral, Ethical or Honest grounds to do so.
In his post Steven Blake has also tried to make out that Martin has defrauded people in some way.
I’m sorry to say it but trying to imply that and I quote Steven Blakes statement:
“OldPain2Go® – a methodology that took me 5 years of hard work to develop and has taken me a further 18 months to polish into the widely acclaimed Methodology it now is” STEVEN BLAKE.
Christ you wasted five years & 18 months of your life then Steven as there is NOTHING NEW in OldPain2Go as explained already.
Another quote from Steven Blake:
“(Please note it took us several months to get OldPain2Go® certification registered as valid for insurance).”

Well once again then you seem to like wasting lots of your time without reason.
FACT = I know of several insurance companies who will insure most any new therapy (whatever its name) when you just honestly tell them that its all based on NLP and Hypnotherapy techniques (which OldPain2Go most certainly is) and they will only charge in the region of around (it varys on circumstance and your personal details etc) £60 a year on average. I know as I put all of my course students in touch with such companies.
Another Quote from Steven Blakes Statement:
“I would like to think that from the trust I placed in him, and the really decent guy he seemed to be, that you have in fact been taught what I taught him, but with his own additional bits, and that he is now only lying to me, so that he can pass off my Intellectual property and copyrighted materials as his own. “
FACT = The only thing Steven Blake owns any copyright on is the Trademarked name of OldPain2Go and also the logo design. Also in copyright law he can protect the actual word for word wording of any written instructions, but the process/technique he cannot claim as IT IS ALL IN PRINT MANY TIMES IN THE PAST way before Steven Blake was even a therapist. So the simple fact is Martin is not lying, he has just realized that what he was told was original IS NOT ORIGINAL AND NOT NEW in any other manner than the Tradename and logo design.
In short Steven Blakes statement comes across to me as an attempt to discredit Martin and also to incite hatred towards him when he has in fact done absolutely nothing wrong as far as I can see based on the evidence I have to hand.
Such implied comments made publicly by Steven Blake about Martin Rothery are also as far as I can see, bordering extremely close to breaching defamation laws
Overall its all very sad indeed and reminded me of what Sick-Mind Fraud so correctly stated many years ago that:
“Most Therapists are merely people still searching for answers to their own issues”
please re-read this post again and well….
You can decide who appears to have issues…
In my personal opinion and in the context of this whole matter is is not Martin.

TO ANYONE TRAINED BY MARTIN ROTHERY.
(A Statement Posted on Facebook by Steven Blake)
Yesterday Martin Rothery made a public announcement on his FaceBook Page. In it he states he has not taught OldPain2Go® for some time. He has not even been teaching a variation of it. He has in fact been teaching all his own work. I apologise to those who thought they were receiving OldPain2Go® – a methodology that took me 5 years of hard work to develop and has taken me a further 18 months to polish into the widely acclaimed Methodology it now is.
Mr Rothery was authorised by me to train OldPain2Go® and as he clearly states he is an independent trainer, I am not his boss. Your contract for purchasing OldPain2Go® was with him.
If Mr Rothery’s latest post is to be believed, unless he told you before training you were getting his own work, he has in fact defrauded you out of whatever he charged you. If Mr Rothery is not being truthful you may just have received a close copy of OldPain2Go® and you may be satisfied with what you got. As Mr Rothery states he will continue teaching the same (whatever it is he provides) and obviously feels that it would not legally infringe my copyrighted material or my registered brand, then he must feel it is sufficiently different to not face legal action from me.
So it would appear either way that you didn’t get what you paid for. If that does NOT concern you, you do not need to take any action. If you are concerned that what you received is not OldPain2Go®, or that you received a poor clone of it then Mr Rothery has no legal right to keep your money and you should write to him demanding a full refund.
As you are in this group it does mean you are the lucky ones as he registered you with us and you do have a Certificate of Completion in OldPain2Go®, it does however throw into doubt whether you are in fact trained in OldPain2Go®, a near copy of it, or whatever Mr Rothery will call it when he launches it.
This depends on whether you believe what he told you at the time or what he is saying now. He has in fact offered to issue his own certificates that he trained you in his method (Please note it took us several months to get OldPain2Go® certification registered as valid for insurance).
I would like to think that from the trust I placed in him, and the really decent guy he seemed to be, that you have in fact been taught what I taught him, but with his own additional bits, and that he is now only lying to me, so that he can pass off my Intellectual property and copyrighted materials as his own.
This has devastated Trudy and I. I took action as soon as I was aware of the deceit, and then terminated his training agreement as soon as the evidence emerged (which goes back all the way to shortly after I trained him).
We are concerned for all of you and will do all we can to ensure that you do get the latest in training to help you be confident and competent in helping people out of pain – that is the whole purpose of why I shared my work. You will not be disadvantaged in anyway and it may be that you really were taught OldPain2Go®. I am as confused as you are.
I will be arranging free training in OldPain2Go® for all those want it, and that will be with me (even if you have had a full refund from him). Following that we will then issue you with a new certificate so that there is no doubt you trained in OldPain2Go®.
